1. Acceptance of these terms
These Terms of Use (“Terms”) govern your access to and use of my1031options.com (“the Site”), operated by Ronald Nielsen, an individual sole proprietor (“we,” “our,” “us”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
We may update these Terms from time to time. The most current version will always be posted on this page with a revised “Last Updated” date. Your continued use of the Site after changes constitutes acceptance of the updated Terms.
2. Eligibility
The Site is intended for use by individuals who are at least 18 years of age and who are evaluating 1031 exchange and Delaware Statutory Trust replacement property options as accredited investors as defined in Rule 501 of Regulation D under the Securities Act of 1933.
Educational content on the Site is publicly accessible. However, our specialist-matching service is restricted to accredited investors who can self-attest to their accredited status. By submitting any form on the Site that requests accreditation status, you represent that the information you provide is accurate.
3. Educational purpose only
All content on the Site is provided for educational and informational purposes only. The Site:
• Is not an offer to sell or a solicitation of an offer to buy any security.
• Does not provide investment, tax, legal, or accounting advice.
• Is not a substitute for professional advice from a qualified registered representative, certified public accountant, or attorney.
• Does not establish a fiduciary, advisor-client, or attorney-client relationship between you and the Site operator.

4. No advice or recommendation
Information provided on the Site, including responses to inquiries, comparisons, frameworks, and content, is general educational information. We do not recommend any specific 1031 exchange, DST, or other investment for any specific person. Decisions about whether to engage in a 1031 exchange or invest in a DST should be made only after consultation with your own tax, legal, and financial advisors and after a thorough review of the offering documents.
5. Specialist matching
If you submit a form on the Site requesting to speak with a specialist, your submission may be forwarded to a FINRA/SIPC-registered representative working with an independent broker-dealer for follow-up. We do not control the actions of any registered representative or broker-dealer firm. Their conduct is governed by their own policies, broker-dealer rules, and applicable securities regulations.
6. Use of the Site
You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the Site by any third party. You agree not to:
• Use the Site in any way that violates applicable law or regulation.
• Engage in any conduct that could damage, disable, overburden, or impair the Site.
• Attempt to gain unauthorized access to any portion of the Site, related systems, or networks.
• Use any robot, spider, or other automated means to access the Site without our prior written consent.
• Submit false, misleading, or fraudulent information through any form on the Site.
• Use the Site to solicit, advertise, or distribute any offering, product, or service.
7. Intellectual property
All content on the Site — including text, graphics, logos, images, illustrations, calculators, frameworks, and underlying code — is owned by the Site operator or licensed to us and is protected by United States and international copyright, trademark, and other intellectual property laws.
You may view, print, or download Site content for your personal, non-commercial use, provided you retain all copyright and other proprietary notices. You may not reproduce, modify, distribute, publicly display, or create derivative works of the Site content without our prior written permission.
8. User-submitted content
Any information you submit through forms on the Site (excluding personal information governed by our Privacy Policy) is subject to the following:
• You represent that the information you submit is accurate and that you have the right to submit it.
• You grant us a non-exclusive, royalty-free, worldwide license to use the information for the purpose of operating the Site, responding to your inquiry, and improving our services.
• You acknowledge that we are not responsible for the accuracy, completeness, or use of any information you submit.

The Site may contain links to or references to third-party websites, services, sponsors, broker-dealers, or other resources. We do not control these third parties and are not responsible for their content, policies, or practices. Inclusion of any link or reference does not constitute endorsement.

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
All real estate and securities investments involve risk, including the possible loss of principal. Past performance is not indicative of future results. Real estate investments are subject to market risks, illiquidity risk, interest rate risk, and other risks specific to real estate.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE SITE OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, REVENUE, GOODWILL, USE, OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR ANY CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability to you for any claim arising out of or in connection with these Terms or your use of the Site will not exceed one hundred U.S. dollars ($100).
12. Indemnification
You agree to indemnify, defend, and hold harmless the Site operator from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any information you submit through the Site.
13. Governing law and dispute resolution
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. You agree that any dispute arising from these Terms or your use of the Site will be resolved exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
14. Termination
We may suspend or terminate your access to the Site at any time, for any reason, without notice. Upon termination, the provisions of these Terms that by their nature should survive (including disclaimers, limitations of liability, indemnification, and governing law) will remain in effect.
15. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
16. Entire agreement
These Terms, together with the Privacy Policy and Disclosures, constitute the entire agreement between you and the Site operator regarding your use of the Site.
